1. Acceptance of Terms
By downloading, installing, accessing, or using the Curbily mobile application ("App"), you agree to be bound by these Terms of Use and End User License Agreement ("Terms"). If you do not agree to these Terms, do not download, install, access, or use the App.
2. Description of Service
Curbily is an AI-powered mobile application that enables real estate professionals to create professional video tours of properties. The App uses artificial intelligence to automatically edit videos, add voiceovers, background music, and transitions to create engaging property tour videos.
3. License Grant
Subject to your compliance with these Terms, Curbily grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal or business use in accordance with these Terms and the App Store terms.
4. User Accounts and Responsibilities
Account Creation: You may need to create an account to access certain features of the App. You agree to provide accurate, current, and complete information during registration.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Age Requirement: You must be at least 18 years old to use the App. By using the App, you represent that you are at least 18 years old.
5. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Upload, create, or share content that infringes on others' intellectual property rights
- Upload content containing malicious code, viruses, or harmful components
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App to create content that is defamatory, obscene, or violates others' privacy
- Interfere with or disrupt the App's functionality or servers
- Create derivative works based on the App without written permission
6. Content and Intellectual Property
Your Content: You retain ownership of the video content you upload to the App. By using the App, you grant Curbily a limited license to process, modify, and enhance your content as necessary to provide the service.
Our Content: The App, including its design, functionality, AI algorithms, and generated enhancements (such as voiceovers and music), are owned by Curbily and protected by intellectual property laws.
Generated Content: You own the final video output created by the App, including AI-generated enhancements applied to your original content.
7. Privacy and Data
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information when you use the App.
8. Subscription and Payments
Subscription Plans: The App may offer various subscription plans with different features and pricing. Subscription fees are charged through your App Store account.
Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Refunds: Refund policies are governed by the App Store's terms and conditions.
9. Disclaimers and Limitations
Service Availability: The App is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.
AI Technology: While we strive for high-quality results, AI-generated content may not always meet your expectations. Results may vary based on input quality and other factors.
Limitation of Liability: To the maximum extent permitted by law, Curbily shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
10. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. You may also terminate your account at any time by deleting the App from your device and contacting us to delete your account data.
11. Updates and Changes
We may update the App and these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes through the App or other reasonable means.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
